  • Sweet Art terms and conditions policy follows the requirements of the Consumer Guarantees Act 1993.
  • Sweet Art reserves the right to change any information on the www.sweetart.nz website at any time.
  • By purchasing something from Sweet Art, you engage in our “service” and agree to be bound to the terms and conditions of Sweet Art as follows:

Acceptance of Terms

These terms and conditions govern all supply of goods and services ("products") by Sweet Art Limited ("we, "us") to you, the purchaser of goods and services from us, including your use of the website at www.sweetart.nz ("the website"). They are effective from 1st November 2023 and will replace all earlier Sweet Art Limited terms of trade and any conditions contained in any document used by you and purporting to have contractual effect.

  • We reserve the right to change these terms of trade by notice to you. Notice may be given by posting the revised terms and conditions on our website.
  • Purchases from our online shop may only be made by persons who are acquiring goods or services for their own use, and you must not acquire goods from us via the website for resupply (whether in trade or otherwise).
  • If you are purchasing on behalf of another entity such as a company, you warrant you have the authorisation to agree to these terms and conditions on behalf of the entity.

Availability and Supply

  • All orders are subject to the availability of those products or services. If for any reason a Product is not available, we will endeavour to notify the non-availability on our online shop.
  • We reserve the right to refuse service to anyone for any reason at any time.

Pricing

  • All prices are in New Zealand Dollars and are inclusive of any Goods and Services Tax ("GST") unless stated to be otherwise but are exclusive of delivery charges. 
  • All prices are correct when published. We reserve the right to alter prices at any time.
  • An invoice will be emailed to you at the email address you supply when you place your order. 
  • You are responsible for ensuring that your contact details are correct.

    • Stripe
    • Afterpay

Credit Card Security

  • All credit card payments are processed via Stripe secure payments system to ensure high levels of payment security and are subject to Stripe terms and conditions.

Pre-Order Reservation

  • If Sweet Art is unable to fulfil and deliver the products within the allocated time frame as written on the website when buying, Sweet Art will process a full refund to the buyer. 
  • Delivery for pre orders will be delayed as per the terms outlined for pre ordering before payment. 

Pre Order Terms and Conditions 

  1. Order Placement:
  • Customers can place pre-orders for our products between November 1st and November 27th.
  • By placing a pre order, you are agreeing to Sweet Art charging the full price of each item at the time of buying.
  1. Payment:
  • Customers will be charged at the time of placing the pre-order.
  1. Order Fulfillment:
  • All pre-orders made between November 1st and November 27th will be dispatched on December 11th.
  1. Notification:
  • Customers will receive a notification or confirmation email when their pre-order is processed on December 11th, including any relevant shipping information.
  1. Cancellations and Modifications:
  • In accordance with these terms, you cannot suspend or cancel your pre order after 3 days of making the order. If you ordered the product by mistake, you have 3 days to cancel or adjust your order by emailing hello@sweetart.nz
  1. Refunds:
  • If customers choose to cancel their pre-order within 3 days of purchase, a full refund will be issued.
  1. Shipping Schedule:
  • Orders will be sent out on December 11th via our chosen shipping method.
  • If Sweet Art is unable to fulfil and deliver the products within the allocated time frame as written on the website when buying, Sweet Art will process a full refund to the buyer. 
  1. Delivery Times:
  • Estimated delivery times may vary based on the shipping method and the destination. Customers will receive tracking information to monitor their package's progress.
  1. Customer Support:
  • Our customer support team is available to assist with any inquiries or concerns related to pre-orders.

By following these terms, we aim to provide a transparent and convenient pre-order experience for our customers.

Gift Cards

  • Gift cards are issued in New Zealand dollars (NZ$), for use on Sweet Art website only (www.sweetart.nz)
  • Gift cards are activated at the time of purchase and remain open for a period of 12 months unless specified otherwise.
  • Whole or partially redeemed gift cards cannot be cancelled or refunded.
  • If the gift card is for a lesser amount than the desired purchase, the recipient is required to pay the difference at checkout via alternative payment methods.
  • Gift cards should be treated like cash and will not be replaced if lost or stolen. Sweet Art will not accept responsibility for lost or stolen gift cards.
  • Items bought with Sweet Art gift cards can be exchanged but not refunded.

  • Sweet Art reserves the right to change these terms and conditions without notice.

Credit Notes

  • Credit notes are issued in New Zealand dollars (NZ$), for use on Sweet Art website only (www.sweetart.nz)
  • Once issued, credit notes expire after 12 months unless specified otherwise.
  • Whole or partially redeemed credit notes cannot be cancelled or refunded.
  • If the credit note is for a lesser amount than the desired purchase, the recipient can pay the difference at checkout via our usual payment methods.
  • The value of credit notes is defined by the amount spent at the time of purchase independently of sales, discounts or promotions.
  • Items bought with credit notes can be exchanged but not refunded.

  • Sweet Art reserves the right to change these terms and conditions without notice.

Discount Codes, Sale Items and Promotional Offers

  • Sale and promotional offers are valid for a limited time, and cannot be applied to previous purchases.
  • Unless specified otherwise, discount codes are applicable to full priced, Sweet Art products only and exclude limited releases.
  • Discount codes cannot be used in conjunction with other offers or promotions.
  • All discounts are applied before shipping and tax.

Product Descriptions 

  • Sweet Art aims to be as accurate as possible when describing the products featured on www.sweetart.nz
  • However Sweet Art does not guarantee that the product description or other content on this website is 100% accurate, complete, reliable or error free and Sweet Art reserves the right to adapt this without prior notice. 
  • We have made every effort to display as accurately as possible the colours and images of our products that appear at the store.
  • Although we aim to have the natural bamboo colour the same for each product sold, sometimes there is variability in this colour due to the laser burning process. 

Intellectual Property of Artist

  • Each Artist that has contracted to design a piece of art for resale under Sweet Art, holds the legal and moral rights to their design work.
  • Sweet Art supports the legal and moral rights for each Artist, enforcing that anyone visiting the www.sweetart.nz website and social media, cannot misappropriate the Artist’s work for their own personal or commercial gain without permission from the Artist.
  • If you wish to contact the artist privately, please contact hello@sweetart.nz to access the Artist’s information.

Delivery and Delivery Charges

  • Prices for goods and services stated on our website are exclusive of any applicable delivery charges.
  • We only deliver to New Zealand street addresses. The cost of delivery is as stated on our website and a total delivery cost will be provided in the order summary in your online shopping basket.
  • We will use all reasonable endeavours to ensure that orders for tangible goods will be dispatched promptly after an order has been placed.

Shipping and Delivery

Processing Time

  • Sweet Art aims to process your order within 48 working hours. Once your order has been dispatched you will receive email confirmation which will include tracking details.
  • During sale and holiday periods, processing of orders may be subject to delay and we ask you to allow a minimum of 4 working days for your order to be dispatched.

Shipping Methods

  • Shipping options and rates will be displayed during the checkout process for your selection.

Estimated Delivery Times

  • Delivery timeframes are estimates and do not take into account processing times, or transit delays. Please note that delivery to rural addresses can result in longer delivery times.

Tracking Your Order

  • Once your order is shipped, you will receive a shipping confirmation email with tracking information. You can use this information to monitor the progress of your delivery.

Shipping Costs

  • The total shipping cost will be displayed during the checkout process before you finalise your order.

Shipping Restrictions

  • We currently ship to New Zealand only. If you reside outside of these areas, please contact us at hello@sweetart.nz for assistance.

Address Accuracy

  • Please ensure that your shipping address is accurate and complete to prevent delivery delays or issues. We are not responsible for incorrect addresses provided by customers.

Delivery Issues

  • If you encounter any issues with the delivery of your order, please contact our customer support team at hello@sweetart.nz. We will assist you in resolving any problems to the best of our ability.

Lost or Damaged Packages

  • In the rare event that your package is lost or arrives damaged, please contact us at hello@sweetart.nz immediately, and we will work to resolve the issue promptly.

Return to Sender

  • If a package is returned to us due to an incorrect address or other delivery issues, additional shipping fees may apply for resending the package.

Returns and Refunds

At Sweet Art, we want you to be satisfied with your purchase. If for any reason you are not, we have a straightforward return and refund policy.

Returns

  • You may return a product within 14 days of your original purchase date.
  • To be eligible for a return, the product must be in its original condition, unused, and in the same packaging.
  • To initiate a return, please contact our customer support team at hello@sweetart.nz to obtain return instructions.

Return Costs

  • The return shipping costs are the responsibility of the customer and will be deducted from the refund amount.
  • Sweet Art reserves the right to charge a restocking fee of $15.00 for each item of goods that are returned in damaged containers or for cancelled orders.

Faulty Goods

  • If the goods you receive are faulty or damaged, please contact us within 14 days of purchase at hello@sweetart.nz with a description and photographic evidence of the damage. This is required for us to liaise with the associated courier company. We also require you to not dispose or use any damaged goods as these need to be collected by the delivery courier company to be assessed for damage. Courier companies do not accept lost or damaged goods claims more than 14 days after pickup.
  • We will assess the situation and provide an appropriate remedy, which may include a replacement, refund, or store credit, as applicable.

Refunds

  • Once we receive and inspect the returned product, we will notify you about the status of your refund.
  • If the return is approved, we will initiate a refund to your original payment method within 5 business days.

Reading and Following Instructions

  • We strongly recommend that you read and follow the product instructions and guidelines provided with your purchase for proper use and care.
  • Failure to follow these instructions may affect the product's performance and could impact your eligibility for a return or refund.

Safety and Precautions with Product

  • Some of the paints contained in this kit are hazardous when exposed to fire, skin, eyes as well as when inhaled or consumed. Please take all necessary precautions to prevent hazardous effects to you and your Whānau:
    • Provide adequate ventilation 
    • Ensure the area you are painting is are flame and spark free 
    • Always wash hands before eating 
    • In case of splashing, wash skin immediately with soap and water 
    • If splashes get into the eye, flood copiously with water at once and obtain medical attention 

Liability Limitation

  • Where you acquire or hold yourself out as acquiring goods or services from us for the purposes of a business, the provisions of the Consumer Guarantees Act 1993 will not apply. 
  • The conditions, warranties and guarantees set out in the Sale of Goods Act 1908 or otherwise implied by statute or common law will not apply and are excluded from these terms of trade.
  • We will always endeavour to have complete and accurate information on our website but to the greatest extent permissible by law we assume no responsibility for the completeness and current accuracy of the information provided on our website.
  • To the greatest extent permissible by law, we exclude all liability we may have to you for any claim except where we have acted in bad faith. This exclusion also applies for the benefit of every officer, employee, contractor, agent of us and anyone else we use to perform our duties or provide services under any agreement you have with us. None of the persons specified above is liable or has to pay you for anything else in connection with or resulting from anything any of us does or does not do, or delays in doing, whether or not it is contemplated or authorised by any agreement you have with us. This exclusion applies whatever you are claiming for and in whatever way liability might arise. This exclusion does not limit any inalienable rights you may have under the Consumer Guarantees Act 1993.
  • Our maximum liability to you (if any) shall be limited to the value of any faulty products or services supplied by us and we, our employees, contractors and agents, will not be liable to you for loss or damage of any kind however that loss or damage is caused or arises.

Applicable Law and Jurisdiction

  • Unless we otherwise agree in writing, this agreement contains all the terms of our relationship and continues to apply no matter where you are located at the time any goods or services are provided to you by us and irrespective of the location where you reside.
  • Use of our website, supply of products or services by us to you and any other matter arising from these Terms and Conditions are subject to the laws of New Zealand. The Courts of New Zealand shall have non-exclusive jurisdiction over all claims or disputes arising in relation to, out of or in connection with these terms of trade, or with the use of website or supply of any services.
  • Where you or any other person who you act for, or who you permit to act for you supplies incorrect information for the purchase of a product or service and we incur cost in any matter concerning that name then we may recover the costs incurred by us from you (including legal costs on a solicitor-client basis).
  • You agree to use our website, products and services in accordance with the applicable laws of the country or countries where your business or organisation is based.
